Terms of Service

These Terms of Service govern your use of the Audio Joiner website at audiojoiner.app and of the Audio Joiner Chrome extension, together referred to here as the service. By using the service you agree to these terms. If you do not agree with them, please do not use the service. How your data is handled is described separately in the Privacy Policy, which forms part of these terms.

Who provides the service

Audio Joiner is developed and operated by an individual developer, reachable at [email protected]. Any notice under these terms may be sent to that address.

What Audio Joiner is

Audio Joiner is a tool for joining audio files into a single file, with editing steps such as reordering, trimming, level adjustment, and fades. Decoding, preview, editing, and export run in your browser on your own device. The service is a software tool: it does not check whether the material you process is lawful, accurate, or suitable for your purpose, and it does not store your work for you.

Eligibility

You may use the service only if you can form a binding contract under the law that applies to you, and only for purposes that law permits. If you use the service on behalf of an organization, you confirm that you are authorized to accept these terms for it.

Your files and your rights in them

You keep every right you already hold in the audio you process. Because the processing runs on your device, we do not acquire your files and claim no licence over them or over the result you export.

You are responsible for the material you process. You confirm that you own the necessary rights to it, or are otherwise permitted to use it in the way you intend, including any copyright, neighbouring rights, and rights of the performers involved. You are responsible for how you use the exported result.

Acceptable use

You agree not to use the service to infringe anyone’s intellectual property, privacy, or other rights, and not to process material that is unlawful where you are. You also agree not to interfere with the service or the infrastructure that delivers it, not to attempt to gain unauthorized access to any part of it, and not to circumvent any technical limitation in it.

You may build on or automate around the service only in ways these terms allow. Reverse engineering is permitted only to the extent that applicable law grants you that right regardless of contract.

The Chrome extension

The extension helps you collect audio you find on web pages and hand it to the Audio Joiner editor. When you choose a source, your browser retrieves that file from the website hosting it, using your existing session with that website. You are responsible for respecting the terms of the websites you take audio from, and for having the right to use what you retrieve. Downloading material from a website may be restricted by that website’s terms or by law, and the extension does not assess that for you.

The extension is distributed through the Chrome Web Store and is also subject to Google’s terms for that store. Its permissions and behaviour are described in the store listing and in the Privacy Policy.

Availability and changes to the service

The service is offered as it is available. Features may change, and parts of the service may be modified, limited, or discontinued. Where a change materially reduces what the service does, we will make that clear in the product where practical. Browsers change too: the service depends on browser capabilities that are outside our control, and a browser change may affect what the service can do.

Intellectual property in the service

The Audio Joiner name, logo, interface, and the software behind them are owned by the developer or licensed to them, and are protected by intellectual property law. These terms give you permission to use the service as an end user; they do not transfer any ownership in it. The service includes third-party open-source components, which are governed by their own licences.

Third-party websites and services

The service links to and interoperates with websites and services operated by others, including the sites you retrieve audio from and the Chrome Web Store. Those are outside our control, and we are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.

Disclaimer

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, that it will operate without errors, or that it will be compatible with every file, browser, or device, or that an export will always match what you expect.

Nothing in these terms excludes or limits any right you have as a consumer that the law where you live does not allow to be excluded or limited.

Limitation of liability

To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, special, or consequential loss, or for lost profits, lost revenue, or lost or corrupted data or audio, arising out of or in connection with your use of the service. Because your files are processed and stored on your own device, keeping your own copies of your source material is your responsibility.

Where liability cannot be excluded, it is limited to the amount you have paid for the service in the twelve months before the event giving rise to it, and otherwise to the minimum permitted by law. These limits do not apply to liability for death or personal injury caused by negligence, for fraud, or to any other liability that the law does not permit to be limited.

Suspension and ending your use

You may stop using the service at any time. Access may be restricted or withdrawn where use breaches these terms or the law, or where it threatens the integrity or availability of the service. The sections on your rights in your files, intellectual property, disclaimers, and liability continue to apply after you stop using the service.

Changes to these terms

These terms may be updated. The effective date at the top of this page is revised when that happens, and a material change will be made clear in the product before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
